Welcome to footnote. These Terms of Service govern your access to and use of the footnote website, online store, products, services, content and related features (collectively, the “Services”).

The terms “footnote,” “we,” “us,” and “our” refer to footnote.

Our Services are powered by Shopify, which provides the technology that enables our online store. However, purchases made through our store are transactions between you and footnote.

By accessing or using our Services, or by placing an order with us, you agree to be bound by these Terms of Service and the policies referenced in them, including our Privacy Policy and Returns & Exchanges Policy.

Please read these Terms carefully before using our Services. If you do not agree with these Terms, please do not use our Services.

1. Eligibility and Use of Our Services

By using our Services, you confirm that you are legally capable of entering into a binding agreement under applicable law.

You agree to provide information that is accurate, complete and up to date when placing an order, creating an account or otherwise communicating with us.

You are responsible for maintaining the security of any account credentials associated with your use of the Services and for activities carried out through your account.

2. Our Products

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and other information displayed on our website are accurate.

However, colours and product appearance may vary slightly depending on your device, screen settings, lighting and other display conditions.

Product images are intended to provide a representation of the product. Minor variations in colour, texture, finish or appearance do not necessarily constitute a defect.

We may discontinue products or limit quantities available for purchase without prior notice.

3. Product Availability

All products are subject to availability.

Adding a product to your cart does not guarantee that the product will remain available until checkout or payment is completed.

If a product becomes unavailable after an order has been placed, we will contact you and may offer an alternative, store credit or refund of the applicable amount, as appropriate.

4. Orders

When you place an order through our store, you are submitting a request to purchase the selected products.

An order is not considered accepted until we confirm the order.

We reserve the right to refuse, cancel or limit any order where reasonably necessary, including in cases involving suspected fraud, inaccurate information, product availability issues, pricing or listing errors, repeated unsuccessful deliveries, or other circumstances that may affect the transaction.

If we cancel or decline an order after payment has been received, any eligible amount paid for the cancelled portion will be handled in accordance with our applicable refund process.

Please carefully review your order details before submitting it. Once an order has been confirmed or dispatched, we may not be able to accommodate cancellation requests.

Purchases are subject to our Returns & Exchanges Policy.

5. Cash on Delivery (COD)

We may offer Cash on Delivery for eligible orders within Pakistan.

By placing a COD order, you confirm that the information provided by you is accurate and that you are willing and able to receive and pay for the order upon delivery.

We reserve the right to restrict or remove COD availability for customers or orders where there is a history of refused deliveries, repeated failed deliveries, fraudulent activity or other misuse of the COD service.

Where an order has already been dispatched, cancellation or refusal may result in applicable shipping or return-to-origin costs.

6. Prices and Payments

All product prices displayed on our website are stated in Pakistani Rupees (PKR) unless otherwise indicated.

Prices, discounts and promotional offers may change from time to time.

The price applicable to your order is the price displayed at the time the order is placed, unless there is a clear pricing or listing error.

Shipping charges and other applicable charges will be displayed during checkout where applicable.

For prepaid orders, you authorize the applicable payment provider to process the amount payable for your order.

For COD orders, payment is due to the courier upon delivery unless otherwise stated.

You agree to provide accurate and complete payment and contact information required to process your order.

7. Promotions and Discounts

Promotional offers, discount codes and special pricing may be subject to additional terms.

We reserve the right to correct errors, modify or discontinue promotions, or refuse the use of a promotional offer where we reasonably believe it has been misused, duplicated, fraudulently obtained or applied contrary to its stated conditions.

Unless expressly stated otherwise, promotions cannot be combined.

8. Shipping and Delivery

We ship orders to eligible locations across Pakistan.

Delivery times provided on the website or by our team are estimates and may vary depending on location, courier availability, weather, public holidays, operational conditions and other circumstances beyond our reasonable control.

We are not responsible for delays caused by courier companies or events outside our reasonable control.

Customers are responsible for providing an accurate and complete delivery address and contact information.

If an order cannot be delivered because of an incorrect address, recipient unavailability, refusal or repeated failed delivery attempts, additional delivery or return-to-origin charges may apply.

Risk relating to the product passes to the customer upon delivery of the order, except where applicable law provides otherwise.

9. Returns and Exchanges

Our Returns & Exchanges Policy forms part of these Terms of Service.

Returns and exchanges are handled strictly in accordance with that policy, including applicable timelines, product-condition requirements, inspection procedures, shipping responsibilities and available resolutions.

Nothing in these Terms is intended to limit any consumer right or remedy that cannot legally be excluded under applicable law.

The footnote name, logo, branding, product names and related designs are proprietary to footnote.

All third-party trademarks and brand names appearing on our Services belong to their respective owners.

11. User Reviews and Feedback

If you submit reviews, comments, photographs, suggestions, ideas or other content to footnote (“Feedback”), you grant footnote a non-exclusive, worldwide, royalty-free right to use, reproduce, display, publish, adapt and distribute that Feedback for purposes related to operating, improving or promoting our Services.

You represent that you have the necessary rights to submit the Feedback and that it does not infringe the rights of another person or entity.

You must not submit content that is unlawful, fraudulent, misleading, abusive, defamatory, threatening, obscene, discriminatory or otherwise inappropriate.

We reserve the right to remove or decline to publish Feedback that we reasonably consider to violate these Terms or applicable law.

Shopify provides the technology and infrastructure that enables us to operate our online store. Purchases made through our store are transactions between you and footnote.

Shopify is not the seller of our products and is not responsible for the products, order fulfilment, returns or exchanges provided directly by footnote.

Your use of our Services is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and otherwise process personal information when you visit our website, place an order, communicate with us or use our Services.

15. Errors and Inaccuracies

We reserve the right to correct such errors or inaccuracies and, where appropriate, cancel or modify affected orders.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Subject to any mandatory rights or remedies available to consumers under applicable law, disputes arising in connection with these Terms or your use of the Services shall be subject to the jurisdiction of the courts having lawful jurisdiction over footnote's principal place of business in Lahore, Punjab, Pakistan.
